How Delta-8 is Made

Delta-8 is found naturally occurring in cannabis, albeit in trace amounts. Typically, CBD is sourced from hemp and converted into an isolate. Then, the CBD isolate is converted into delta-8 through a process known as isomerization.

Since hemp can be legally grown anywhere in the US and, therefore, more readily available, delta-8 is typically sourced from hemp.

Is Delta-8 Legal?

When it comes to legal status, delta-8 currently exists in a bit of a gray area.

Currently, there are few state laws that specifically address delta-8 THC at this time, and the majority of state laws are relevant to marijuana or cannabis use.

As such, the language covers terms relevant to marijuana, cannabis, THC, CBD, or delta-9 tetrahydrocannabinol.

In one proposed rule, the federal Drug Enforcement Administration (DEA) has indirectly defined delta-8 THC as a Schedule I controlled substance, thus defining it as federally illegal. However, this ruling has not been finalized.

Typically, delta-8 is sourced from industrial hemp rather than high-THC cannabis, which allows it to be sold in many states–even ones where cannabis is illegal.

More specifically, almost all delta-8 THC products that are currently on the market are derived from CBD extracted from federally legal hemp.

Now, this may be a bit confusing, since technically, hemp is a cannabis plant, and the name Cannabis sativa is the same latin name for the plant that produces high-THC marijuana.

In the 2018 farm bill, industrial hemp is officially classified as cannabis that contains less than 0.3% THC. Specifically, it was defined as "All derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent." But when we discuss "cannabis" or "marijuana", we’re commonly referring to cannabis plants with THC content of 0.3% or higher.

This language does not contain any delta-9 THC, making delta-8 legal through a gray area.

However, there are some states that have chosen not to adopt this specific language of the farm bill in their own state laws, thus banning delta-8 in certain states. Both manufacturers and vendors of delta-8 tend to sell only to states with laws that follow the same language as the 2018 Farm Bill. Still, there are some manufacturers that may only sell to certain states based on their own interpretation of a state’s laws.

Why People Love Delta-8 THC

According to the National Cancer Institute, delta-8 interacts with the body by binding to CB1 and CB2 receptors throughout the endocannabinoid system. The endocannabinoid system (ECS) helps keep us in homeostasis–in other words, it helps maintain complete balance throughout the body.

According to the National Cancer Institute, one of the benefits behind delta-8 THC are its neuroprotective properties, which it creates by inhibiting the release of adenylyl cyclase while regulating potassium and calcium channels in the central nervous system, potentially boosting brain health.

Based on anecdotal evidence, delta-8 products have garnered a reputation for creating a high that’s far more mellow than delta-9.
